Privacy Notice - Nutrient Mitigation Fund

What this document is for

This privacy notice provides details on how we use your personal information for the purposes of processing your application to the Nutrient Mitigation Fund. By ‘we’, we mean Broadland District Council as the Data Controller and the funder/commissioner of the programme. In line with our Agreement with central government regarding the allocation of these funds, we work collaboratively with all other affected councils in the catchment (Broads & Wensum) as detailed further on this Notice.

A successful outcome will be the award of funding for which a loan agreement or grant funding agreement will need to be agreed. The information you provide will form part of this agreement.

By ‘use’ we mean the various ways it may be processed, including storing and sharing the information.

Who provides this information

The information we hold is information you have provided to us as an applicant for the Nutrient Mitigation Fund and either (or both) the Capital Scheme or Feasibility Scheme.

What information we hold about you 

We collect personal information whenever you provide it to us. This personal information may include the following:

  • name, address, and contact details (email and telephone number)
  • signatures
  • project details
  • financial details relating to payments and income
  • any other information you may provide to us within the context of your application or representations

What we use your information for

We use your personal information to:

  • respond to any enquiries which you make to us relating to the funding, scheme or related services
  • consider and determine your application for funding, which will include sharing the data with other local authorities and specialists, after which you will be notified of the outcome and if successful
  • if successful, provide funding, monitoring, funding agreement
  • perform our contractual obligations in relation to any legal agreements between us and you
  • assess the quality of our services and evaluate and improve our policies and procedures.

The legal basis for processing your information

We have legal grounds to process this information under the UK GDPR because it is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Who we may share your data with

To enable us to consider and assess the schemes, we may disclose your personal data to senior officers and councillors that form the Officer Working Group and Member Working Group of the local planning authorities involved in the programme (Breckland Council, Broadland District Council, North Norfolk Council and South Norfolk Council), and contracted service providers that will provide specialist analysis in the course of assessing and determining the application.

We may also share information to law enforcement and regulatory agencies in connection with any investigation to help prevent unlawful activity or as otherwise required by law.

Keeping your data secure

We will use technical and organisational measures to safeguard your personal data. We store your personal data on secure servers and ensure access to your personal data is limited to authenticated and approved staff.

While we will use all reasonable efforts to safeguard your personal data, you acknowledge that the use of the internet is not entirely secure and for this reason we cannot guarantee the security or integrity of any personal data that are transferred from you or to you via the internet.

Retention of data 

How long your data is retained by us will depend on how and when you provide us with your information.

Where you make an application that is unsuccessful or enquiry we will keep your data for up to 2 years from the point of contact/application.

If you are successful with your funding application we will keep your data for 2 years after the conclusion the Scheme.

Changes to this Notice 

We may change this policy from time to time. You should check this policy frequently to ensure you are aware of the most recent version that will apply each time you interact with us.
